1. Agreement to Terms

By accessing or using the Tantalum Growth website at tantalumgrowth.com (the “Site”) and any services offered through it (the “Services”), you agree to be bound by these Terms & Conditions (“Terms”). If you do not agree to these Terms, do not use the Site or Services.

2. Description of Services

Tantalum Growth provides exclusive lead generation services for insurance agencies and brokerages. Our Services include, but are not limited to, the delivery of exclusive insurance quote requests sold to one agency per lead, intake through website forms and sales consultations, and related advisory services.

3. Eligibility

You must be at least 18 years of age and have the legal authority to enter into a binding agreement on behalf of yourself or your organization to use our Services. By using the Site, you represent and warrant that you meet these eligibility requirements.

4. Lead Exclusivity

Each quote request we deliver is sold to one customer agency only, as further described in your written service agreement. Using the Site or submitting a form does not guarantee lead delivery, pricing, or a business relationship. Those terms are only binding after execution of a separate written agreement between you and Tantalum Growth.

5. Lead Quality and Performance

While we strive to deliver high-quality, verified leads, Tantalum Growth does not guarantee specific conversion rates, bind rates, revenue outcomes, or return on investment. Performance data and statistics presented on the Site (including ROI figures, close rates, and comparative metrics) are based on aggregated data from partner agencies and are provided for illustrative purposes only. Individual results may vary based on your market, agency capabilities, lines of business, and market conditions.

6. User Obligations

By using our Site and Services, you agree to:

• Provide accurate and truthful information in all forms and communications
• Use leads and prospect data in compliance with all applicable laws, including TCPA, CAN-SPAM, and state-specific regulations
• Not resell, redistribute, or share leads received through our Services with third parties
• Maintain the confidentiality of any proprietary information or data shared by Tantalum Growth
• Not attempt to circumvent, reverse-engineer, or interfere with the operation of the Site or Services

7. Payment Terms

Pricing, payment schedules, and billing terms are established in the separate written service agreement. Tantalum Growth reserves the right to modify pricing for new engagements or renewals with reasonable advance notice. Failure to pay may result in suspension or termination of lead delivery.

8. Intellectual Property

All content on the Site — including text, graphics, logos, design elements, and software — is the property of Tantalum Growth or its licensors and is protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from any content on the Site without our prior written consent.

9. Disclaimer of Warranties

The Site and Services are provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Tantalum Growth does not warrant that the Site will be uninterrupted, error-free, or free of harmful components.

10. Limitation of Liability

To the fullest extent permitted by applicable law, Tantalum Growth and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, revenue, data, or business opportunity — arising out of or related to your use of the Site or Services, regardless of the theory of liability. Our total aggregate liability shall not exceed the amount you paid to Tantalum Growth in the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless Tantalum Growth and its affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Site or Services, your violation of these Terms, or your violation of any applicable law or the rights of any third party.

12. Termination

We reserve the right to suspend or terminate your access to the Site and Services at any time, with or without cause, and with or without notice. Upon termination, your right to use the Site ceases immediately. Provisions that by their nature should survive termination (including limitations of liability, indemnification, and intellectual property) shall survive.

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in Florida.
