1. Agreement to Terms

By accessing the Tantalum Growth website at tantalumgrowth.com (the “Site”), completing our consumer quizzes (the “Quiz”), or creating an account in our lead portal (the “Portal”), you agree to be bound by these Terms & Conditions (“Terms”). If you do not agree, do not use the Site, Quiz, or Portal.

2. Eligibility

You must be at least 18 years of age to use this Site. Final-expense buyers using the Portal must hold a valid insurance license in their operating states. Business-funding buyers must be authorized to originate or fund in the states they request. All Portal users must possess the legal authority to bind their business to these Terms.

3. Terms for Quiz Users

Nature of Service: For consumers, Tantalum Growth is a matching and referral service. We are not an insurance carrier and we are not a lender. We do not issue policies, bind coverage, make credit decisions, or guarantee that a specific carrier or funding partner will accept your request.

Information Accuracy: You agree to provide truthful and accurate information throughout the Quiz.

Consent to Distribution: You authorize Tantalum Growth to share, transfer, or sell your submitted information to one matched buyer in the relevant vertical (licensed insurance professionals for final expense, or funding partners for small-business financing), including for aged distribution to additional buyers after the initial exclusivity period described in Section 7.

No Cost: There is no charge to consumers for using the Quiz to request comparison quotes, as indicated on our Site interface.

4. SMS Phone Verification (OTP)

Program: When phone verification is enabled on a quote form, we send one-time SMS security codes through Twilio Verify so you can confirm you control the mobile number you entered. Message frequency varies; codes are sent only when you click Send code or Resend code.

By providing your phone number and clicking Send code on our quote form, you consent to receive a one-time transactional security code on your mobile device. Standard message and data rates may apply. For assistance, reply HELP to the number from which you received the message, or contact us at hello@tantalumgrowth.com. To stop receiving messages, reply STOP at any time. Carriers are not liable for delayed or undelivered messages.

5. Terms for Portal Users (Buyers)

Authorized Use: Buyers are granted access to the Portal solely to receive, manage, and track purchased leads.

Resale Prohibition: You are strictly prohibited from reselling, brokering, redistributing, or sharing leads received through our Services with any third-party agency, agent, or broker.

6. Buyer Lead Delivery SMS Alerts

Program: Buyers may optionally receive transactional SMS alerts when a lead is assigned to their Portal account. These messages are account notifications about lead delivery—not marketing to consumers and not solicitations to purchase leads via text.

Opt-in: Consent is obtained only through the authenticated Portal web form at https://www.tantalumgrowth.com/portal (Settings → Lead delivery). By adding one or more mobile numbers and saving delivery settings, you request SMS alerts at those numbers. SMS is disabled unless at least one number is saved. You may add up to three numbers.

By adding one or more mobile numbers under Portal Settings → Lead delivery and saving those settings, you consent to receive transactional SMS alerts from Tantalum Growth about leads assigned to your buyer account. These messages are account notifications for opted-in agents only—not consumer marketing or lead solicitation. Message frequency varies and depends on lead volume (typically a few messages per day when leads are delivered; none when no leads are assigned). Message and data rates may apply. For assistance, reply HELP or contact hello@tantalumgrowth.com. To stop receiving messages, remove your numbers in Portal delivery settings or reply STOP at any time. Carriers are not liable for delayed or undelivered messages.

7. Lead Delivery & Exclusivity (The 90-Day Rule)

Initial Exclusivity: Leads delivered to a buyer account are sold as exclusive at the point of real-time generation. The data will be delivered to exactly one (1) buyer account.

The 90-Day Exclusivity Window: This exclusivity remains in effect for a period of ninety (90) days from the initial delivery timestamp.

Aged Lead Conversion:Upon expiration of the 90-day window, Tantalum Growth retains the absolute right to re-categorize the lead data as an “Aged Lead” and resell it to other third parties at its sole discretion. Tantalum Growth reserves the right to modify this exclusivity window length for future lead packages.

8. Payment Terms & Strict No-Refund Policy

Portal Orders: Lead packages are purchased within the Portal via credit card.

Strict No-Refund Policy:Due to the instant, digital nature of real-time lead delivery, all sales are final. No refunds, credits, card chargebacks, or reversals will be granted for any reason—including unused package balances, uncontacted leads, low contact rates, or dissatisfaction with lead quality.

Feedback Rating:The “Lead Rating” feature (Good/Bad) in the Portal is purely for internal algorithm optimization. Submitting a “Bad” rating does not constitute a valid dispute and does not trigger an automatic lead credit or refund.

9. User-Generated Portal Content (Thank-You Pages)

The Portal permits buyers to customize the consumer-facing post-quiz “Thank-You” experience by uploading text, images, and booking links. Buyers assume sole and absolute compliance responsibility for this content under applicable advertising, licensing, and professional-conduct laws. You may not misrepresent your identity, credentials, or products.

10. Intellectual Property

All content on the Site, Quiz layout, and Portal interface—including text, graphics, logos, and software—is the property of Tantalum Growth or its licensors and is protected by applicable intellectual property laws.

11. Disclaimer of Warranties

The Site, Quiz, Portal, and Leads are provided “as is” and “as available” without warranties of any kind. Tantalum Growth does not warrant that consumer-submitted data will be 100% free of human error or that lead delivery will be uninterrupted.

12. Limitation of Liability

To the fullest extent permitted by law, Tantalum Growth shall not be liable for any indirect, incidental, or consequential damages, including loss of profits, revenue, or business opportunities. Our total aggregate liability to any buyer shall not exceed the total amount paid by that buyer to Tantalum Growth in the twelve (12) months preceding the claim.

13. Indemnification

By Quiz Users: You agree to indemnify us against any claims resulting from your submission of fraudulent contact data.

By Portal Buyers: You agree to indemnify, defend, and hold harmless Tantalum Growth from any claims, regulatory fines, or lawsuits arising out of your subsequent communications with leads (including alleged TCPA, CAN-SPAM, or DNC violations) or any compliance infractions originating from your custom Thank-You page assets.

14. Termination

We reserve the right to suspend or terminate access to the Portal or Site at any time, without notice, for any violation of these Terms—including lead reselling, deceptive consumer practices, or non-payment.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles. All legal proceedings shall be brought exclusively in the state or federal courts located in Florida.

16. Changes to These Terms

We may revise these Terms at any time. Continued use of the Site, Quiz, or Portal after updates constitutes acceptance of the revised Terms.
